Meese Orbitron Dunne Company, Division of Meese, Inc. (“Meese Orbitron Dunne”) warrants that products manufactured and sold by it will conform to agreed specifications, it will be fit for the uses or applications for which designed and will be free from defects in material and workmanship. This warranty will remain in effect for a period of one (1) year from date of delivery. Meese Orbitron Dunne, at its option, will either replace or repair any nonconforming or defected products, provided Meese Orbitron Dunne is given written notice of and an opportunity to inspect the nonconforming or defective products within thirty (30) days after the discovery of the nonconformity or defect. This warranty does not apply to products that have been subject to misuse, misapplication or improper repair; or, being otherwise damaged by the fault or negligence of anyone other than Meese Orbitron Dunne.
This Warranty is expressly made in lieu of all other warranties, express or implied, including, without limitations, warranties of merchantability or fitness for a particular purpose. Meese Orbitron Dunne shall not be liable for any consequential, incidental or other damages.
